Electronic Communications Policy
You, on behalf of yourself and your child, if applicable, acknowledge electronic communications, including without limitation, e-mail, facsimile, video chat, messaging, and cell phone (“Electronic Communications”) with Montera, Inc. (d/b/a Forta) (“Forta”) are not secure or confidential methods of communications. As such, you expressly waive any obligation of Forta and Forta’s direct and indirect parents, subsidiaries and affiliates, affiliated persons, partnerships and corporations, successors and assigns, and all of its past and present directors, members, officers, shareholders, agents, partners, contractors, consultant, representatives, and employees (“Affiliates”) to guarantee confidentiality with respect to correspondence using such means of communication. You acknowledge that all such Electronic Communications may become part of the Patient's medical records. By providing your contact information, you authorize Forta to communicate with you through Electronic Communications regarding your or your child’s (if applicable) (the “Patient”) personal health information. You acknowledge, understand and agree that: (a) Electronic Communications are not a secure medium for sending or receiving personal health information and a third party may have access; (b) Although Forta will make reasonable efforts to keep Electronic Communications confidential and secure, neither Forta nor Forta’s Affiliates can assure or guarantee confidentiality of Electronic Communications; (c) In the sole discretion of Forta or Forta’s Affiliates, Electronic Communications may be made a part of Patient’s permanent medical record; (d) You understand and agree that Electronic Communications are not an appropriate means of communication regarding emergency or other time-sensitive issues or for inquiries regarding sensitive information; and (e) You are authorized to communicate on behalf of the Patient. In the event of an emergency, or a situation in which the Patient could reasonably expect to develop into an emergency, you should call 911 or the nearest emergency room and follow the directions of emergency personnel. If You do not receive a response to an Electronic Communication, you agree to use another means of communication to contact Forta. Neither Forta nor Forta’s Affiliates will be liable to you for any loss, cost, injury, or expense caused by, or resulting from, a delay in responding to you as a result of technical failures; including, but not limited to, (i) technical failures attributable to any internet service provider; (ii) power outages, failure of any electronic messaging software, or failure to properly address an Electronic Communication; (iii) failure of the Practice’s computers or computer network, or faulty telephone or cable data transmission; (iv) any interception of Electronic Communications by a third party; or (v) Your failure to comply with the guidelines regarding the use of Electronic Communications set forth herein.
